1. Controller and data protection officer

The responsible controller as defined in art. 2 no. 7 GDPR is GRTgaz Deutschland GmbH, Rosenthaler Straße 40/41 - 10178 Berlin, Germany (hereinafter “Appygas”, “appygas” or “we/us/our”). The data protection officer is Dr. Gregor Scholze, to be contacted through Appygas.

2. Purpose and subject of processing

In certain cases, we may require your name, address and further contact details or professional attributes. We use this information to manage our contractual relationship, to address technical issues, and, if you consented to receive updates and information, to provide you with marketing material.

Further data is collected and processed automatically. When our website is accessed, the following data is saved automatically for organisational and technical reasons: the names of the web pages you have visited and the operating system and browser type you use, date and time of your visit to our website, the search engines you used, the names of downloaded files and your IP address and cookies under the terms of the section “Cookies” of this Privacy Policy.

We assess collected data automatically in an anonymised or pseudonymised form for statistical purposes in order to continuously improve our website and to make the design of our offerings on the internet more attractive. We do not create any user profiles. The anonymous or pseudonymous data are saved separately from personal information on secured systems, and they are not linked to the identity of any individual. Your personal data and your privacy are therefore protected at all times.

3. Legal basis for processing

The processing of data is necessary to provide the requested services (art. 6 para. 1 lit. b GDPR) as described in our General Terms and Conditions (“GTC”), to contact you and to facilitate communication between users of the Trade module as described in our Terms of Service.

By providing information through the forms on our website, you agree with the processing of that information (art. 6 para. 1 lit. a GDPR). Failure to provide information marked as required will prevent closure of a contractual relationship regarding our services.

You can revoke your consent anytime by closing your account. Withdrawal will not affect the lawfulness of prior processing. Marketing material will be provided only upon request (art. 6 para. 1 lit. a GDPR); you can revoke your consent to the reception of marketing material anytime.

4. Recipients

All employees and services providers with access to your data are obliged and committed to privacy and to observance of the provisions of the GDPR. Our security precautions are continuously revised to keep abreast with latest technological developments. Third party data processors might include providers of Customer Relationship Management and providers of similar services.

The personal data will not be propagated to third parties without your permission unless a propagation to third parties is necessary for providing the services (in particular data storage and maintenance) or required by law.

We are required to provide the European Energy Exchange AG, Augustplatz 9, 04109 Leipzig (“EEX”) on a yearly basis with certain information regarding our Users. The data provided to EEX contains anonymized information regarding what type of information was used by a User and the frequency of use of the data. The User agrees and consents that Appygas provides EEX with such User´s data as required by EEX.

5. Storage period

Upon closure of your account, all personal data will be erased after the expiry of the limitation period of 10 years beginning on 1 January of the year following the closure of your account, as provided by sec. 199 para. 3 no. 1 of the German Civil Code (“BGB”) and sec. 147 para. 3 of the German Tax Code (“AO”).

6. Access, rectification, erasure, objection and complaints

You have the right to request access to and rectification or erasure of personal data or restriction of processing concerning the data subject or to object to processing as well as the right to data portability. You have the right to lodge a complaint with a supervisory authority (art. 13 para. 2 lit. b-d GDPR).

7. Google Analytics

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies, which are text files placed on your computer, to help the website analyse how users use the site (see also below). The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. In case of activation of the IP anonymisation, Google will truncate/anonymise the last octet of the IP address for Member States of the European Union as well as for other parties to the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is sent to and shortened by Google servers in the USA. On behalf of the website provider Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage to the website provider. If you use external links that are offered on our website, this Privacy Policy does not apply to these links. When we offer links, we strive to ensure that our privacy and security standards are also observed by these. We do not, however, have any influence on compliance with privacy and security regulations by other suppliers or providers.
